In today’s rapidly changing world, it is no longer enough for enterprises to have common advantages and rest on their laurels. It is necessary to constantly improve efficiency, competitiveness, quality of products and services. The consumer will remember the company only in the case when it produces products (provides services) either of very good quality or of very bad one. In all other cases, the probability of getting lost in the mass is big enough.
One of the most powerful levers in the competitive struggle is certification, which has been practiced in many countries of the world for more than 100 years in one form or another. Certification has appeared in connection with the need to protect the domestic market from unwilling products, and to determine the responsibility of the supplier (producer, seller) for putting it into circulation.
The beginning of the formation of the current National System of Conformity of the Republic of Belarus was laid back in 1992. It was then that organizational and methodological documents were developed and the relevant laws of the Republic of Belarus were adopted. Obligatory certification of products, works and services was introduced in the Republic of Belarus by the resolution of the Council of Ministers of the Republic of Belarus of 22.09.1993 No. 635. The same decree determined the nomenclature of products, works and services subject to obligatory certification.
Currently, the National System for Conformity Assessment is in force in the Republic of Belarus, the main provisions of which are set out in the TCH 5.1.01-2012 “The National System for Conformity Assessment of the Republic of Belarus. Basic provisions”. General management is carried out by the National Body for Conformity Assessment of the Republic of Belarus (Gosstandart). Activities to confirm compliance are guided by three laws in this area:
- “On technical regulation and standardization”;
- “On Protection of Consumer Rights”;
- “On the assessment of compliance with the requirements of technical regulatory legal acts in the field of technical regulation and standardization”.
Based on the laws, the rules for carrying out conformity certification work within the national system were established by the Resolution of the State Committee for Standardization of the Republic of Belarus “On approval of the Rules for the Conformity of the National System of the Republic of Belarus” dated May 26, 2011 No. 23.
Information on the procedures for confirming compliance (products, services, personnel), operating schemes, rules for marking with a mark of conformity, etc. are reflected in the following technical normative legal acts in the field of technical standardization and certification:
- TCH 5.1.01-2012 “National system of conformity confirmation of the Republic of Belarus. Basic provisions”;
- TCH 5.1.02-2012 “National system of conformity confirmation of the Republic of Belarus. Certification of products. Basic provisions”;
- TCH 5.1.03-2012 “National system of conformity assessment of the Republic of Belarus. Declaration of conformity of products. Basic provisions”;
- TCH 5.1.04-2012 “National system of confirmation of conformity of the Republic of Belarus. Certification of work execution, rendering of services. Basic provisions”;
- TCH 5.1.05-2012 “National system of confirmation of conformity of the Republic of Belarus. Certification of management systems. Basic provisions”;
- TCH 5.1.06-2012 “National system of confirmation of conformity of the Republic of Belarus. Certification of professional competence of personnel. Basic provisions”;
- TCH 5.1.08-2012 “National system of conformity confirmation of the Republic of Belarus. Marks of conformity. Description and procedure of application”;
- TCH 5.1.09-2012 “National system of confirmation of conformity of the Republic of Belarus. Certification of professional competence of experts-auditors”;
- TCH 5.1.10-2012 “National system of confirmation of conformity of the Republic of Belarus. The order of keeping the register”.
Within the framework of the National System of Conformity Assessment the following works are carried out:
- declaring of products;
- certification of products;
- certification of works and services;
- certification of management systems.
Confirmation of conformity within the framework of the National System may be mandatory or voluntary:
- mandatory confirmation of compliance is carried out in the form of mandatory certification of products, systems, performance of work, provision of services or declaration of products for compliance with the requirements of technical regulatory legal acts;
- voluntary confirmation of compliance is carried out in the form of voluntary certification of products and systems. Voluntary certification is carried out according to the same rules and procedures as the mandatory one.
Failure to comply with the rules and procedures for mandatory confirmation of product compliance with the requirements of the technical regulations of the Customs Union, the Eurasian Economic Union, the Republic of Belarus, as well as the sale of products subject to mandatory conformity certification, without a certificate of compliance or using certificates of compliance, which are suspended, shall be sanctioned by a fine.
These norms are stipulated by the Decree of the President of the Republic of Belarus No. 48 of 09.02.2015 “On Measures to Ensure State Control (Supervision) over Compliance with the Requirements of Technical Regulations”, as well as Article 23.12 of the Code of the Republic of Belarus on Administrative Offenses.
